Article 1 – Definitions
1.1. In these terms and conditions, the following terms are used in the following meaning:
a. That's the Spirit: The online webshop trading under the trade name That's the Spirit, registered with the Chamber of Commerce under registration number 86035649 and located at Struisenburgstraat 40, 3063 BR Rotterdam.
b. Customer: The natural person or legal entity that enters into an agreement with That's the Spirit.
c. Agreement: The agreement between That's the Spirit and the Customer.
d. Product(s): The goods offered and sold in the online shop of That's the Spirit

Article 2 – Applicability
2.1. These general terms and conditions apply to all offers, orders, and agreements between That's the Spirit and the Customer, unless otherwise agreed in writing.

Article 3 – Order and Agreement
3.1. An agreement is concluded when the Customer places an order in the That's the Spirit online store and That's the Spirit has confirmed this order.
3.2. That's the Spirit reserves the right to refuse or cancel an order if there are reasonable grounds to believe the Customer will not fulfill their obligations.

Article 4 – Delivery
4.1. That's the Spirit will endeavor to deliver ordered products as quickly as possible within the specified delivery time. However, this delivery time is indicative and not binding.
4.2. The Customer is responsible for the accuracy of the delivery address provided. Any costs resulting from incorrect address information will be borne by the Customer.
4.3. Risk of loss and damage to the products passes to the Customer upon delivery.

Article 5 – Returns
5.1. The Customer has the right to return the received products within 14 days of receipt, in accordance with the right of withdrawal as legally defined in the Netherlands and Belgium.
5.2. That's the Spirit will accept the return and refund the purchase price, provided the products are returned undamaged and in their original condition.
5.3. Orders must be returned to That's the Spirit, Struisenburgstraat 40, 3063BR Rotterdam.
5.4. Return shipping costs are borne by the Customer, unless otherwise agreed.

Article 6 – Warranty
6.1. That's the Spirit offers the statutory warranty on the delivered products.
6.2. Complaints about defects or shortcomings must be reported in writing to That's the Spirit as soon as possible.

Article 7 – Privacy
7.1. That's the Spirit processes the Customer's personal data in accordance with applicable privacy legislation. See our Privacy Policy for more information.

Article 8 – Applicable law and disputes
8.1. These general terms and conditions and the agreement are governed by Dutch law.
8.2. Disputes between That's the Spirit and the Customer will initially be submitted to the competent court in the district where That's the Spirit is established.

Article 9 – Amendments
9.1. That's the Spirit reserves the right to amend these terms and conditions at any time. The most recent version of the terms and conditions can always be found on the That's the Spirit website.

Article 10 – Purchase of Courses via Third Party Platform
10.1. Courses offered and purchased through That's the Spirit's online platform are non-returnable, and no refunds will be provided for such purchases.

10.2. Courses are purchased through That's the Spirit, but the final delivery and access process for the courses takes place on the platform of the third party responsible for offering the courses to the Customer. The Customer will be redirected to the relevant third party's platform to take the course, and the Customer must comply with the terms of use and policies of that third party.

10.3. That's the Spirit accepts no liability for any issues, disputes, or problems relating to the courses offered by the third party, including but not limited to the content, quality, availability, or technical aspects of the courses.

10.4. It is the Customer's responsibility to familiarize themselves with the terms and conditions and policies of the third party offering the courses and to resolve any questions or disputes directly with that third party.

10.5. That's the Spirit reserves the right to terminate or suspend access to courses on the third-party platform at any time for violations of these Terms and Conditions or the third-party's terms and conditions, without any obligation to provide a refund.

10.6. Any payments made for the purchase of courses through the That's the Spirit platform are non-transferable to other products or services and are non-refundable.

10.7. By purchasing courses through That's the Spirit and proceeding to the third-party platform, the Customer agrees to the aforementioned terms and conditions regarding the purchase of courses through a third party.
